Child abduction



A girl stolen as a newborn from a hospital in Jacksonville, Florida, has been found alive in South Carolina after more than 18 years, police say.
Kamiyah Mobley, who was abducted in July 1998, was found after a tip.
Authorities in Walterboro, South Carolina, have charged Gloria Williams, 51, with kidnapping.
Ms Mobley was living under another name and believed Ms Williams to be her mother. The biological family have been notified of the news.
Jacksonville Sherriff's Office said DNA tests had confirmed Ms Mobley's identity.
She appeared in good health, a "normal 18-year-old woman", it said.

At first reading there is no question that this woman committed a heinous crime.

However, she is a social worker and church-going and abducted the baby after sitting with the mother for more than 5 hours.

The mother was an underage teen and the father was in jail for drug offences. The mother subsequently received a large settlement from the hospital.

To what extent are any of the above factors mitigating ones, in your opinion?

None! Unless you live under a rock, there are legally sanctioned systems to provide parties with this entity called "informed consent". Adoption legally entails that when approved by a court the adoptive parents then assume any and all responsibilities for the adopted child just as if the child was born to them.

While there are an unknown number of minor age children who are raised partially or in toto by family members, the natural parents still retain the legal responsibility for the child, and all that goes with that. Even if the natural mother/father die/disappear off the face of the earth whoever is raising the child has NO legal standing (having said that, legal requirements are often "waived" when it suits the powers to be; example: when enrolling for school, proof of birth is required; this is a task left to some low level school employee, and in the real world, if none "appears", that "requirement" is effectively "waived".

"Ignorance of the law" is often conveniently cited by those involved when monies (such as state welfare financial assistance programs) are involved.

I agree. You cant excuse people using their own set of rules. There has been a lot of damage done here on so many levels.
