It sound like there are a combination of problems here. Yes, the bloke should be given some consideration, given his work in the aftermath of 9/11 he should be shown mercy. However, the fact that he is an illegal alien (technically), and he has done nothing to redress this, makes him a target for situations such as this. Again, the bloke that was deported after arriving "illegally" at 4 is another case where the letter of the law is applied. It may well be that the law is that poorly drafted that there is no mitigation permissible.

The law must needs be reviewed as an urgency and these cases should both be held in abeyance until the law is corrected. In all cases, those who arrive by other than legal means must needs redress the situation or it may well become a problem for their progeny.
